Terms & Conditions
Last Updated: September 2026
These Terms & Conditions are incorporated into and made part of each estimate, quote, proposal, work order, or contract (“Agreement”) issued by Home Turf & Hardscapes LLC (“Home Turf,” “Contractor,” “we,” “our,” or “us”) to the customer or property owner (“Customer,” “Owner,” or “you”).
The customer information, project address, scope of work, contract price, applicable taxes, deposit, payment schedule, estimated project dates, materials, specifications, and other project specific information contained in the Agreement are incorporated herein by reference.
By accepting or electronically signing an Agreement with Home Turf, the Customer acknowledges receiving, reviewing, and agreeing to these Terms & Conditions.
1. SCOPE OF WORK
Home Turf will provide the labor, materials, equipment, supervision, and services specifically described in the Agreement.
Only work specifically identified in the Agreement is included in the contract price. Work, materials, demolition, hauling, repairs, irrigation modifications, drainage improvements, permits, HOA requirements, or other services not specifically included are excluded unless subsequently authorized through an approved written change order.
Drawings, photographs, renderings, samples, and conceptual designs are intended to illustrate the general appearance of the proposed project. Actual field conditions, dimensions, grades, product characteristics, and installation requirements may result in reasonable variations.
2. DEPOSIT & PAYMENT
Unless otherwise stated in the Agreement, a deposit equal to fifty percent (50%) of the total contract price is due upon acceptance of the Agreement.
The remaining fifty percent (50%) is due upon completion of the contracted work.
Amounts resulting from Customer approved written change orders will be added to or deducted from the contract price. Unless otherwise stated in the change order, additional amounts are due with the final payment.
Payment is not contingent upon the Customer receiving financing, reimbursement, rebates, incentives, insurance proceeds, or payment from another person or entity unless Home Turf expressly agrees otherwise in writing.
3. CANCELLATION & REFUNDS
Home Turf provides the Customer with a three (3) calendar day cancellation period beginning on the date the Agreement is accepted or signed.
If Home Turf receives written cancellation within the three day cancellation period, the Customer will receive a 100% refund of the deposit.
If the Customer voluntarily cancels after the three day cancellation period, 50% of the deposit will be refunded and 50% of the deposit will be retained by Home Turf, subject to applicable law.
The Customer may also be responsible, to the extent permitted by law, for authorized work already performed and nonrecoverable project specific expenses incurred before cancellation, including specially ordered or nonreturnable materials, delivery charges, permits, engineering costs, and restocking charges. Any amounts retained or charged will be appropriately credited to avoid duplicate recovery of the same expense.
Cancellation must be provided to Home Turf in writing or through another documented electronic communication.
Nothing in this section limits any cancellation right provided by applicable law that cannot legally be waived or modified.
4. CHANGE ORDERS
Any addition, deletion, substitution, upgrade, modification, or other change to the original scope of work that affects the work, materials, quantities, price, or project schedule must be documented in writing.
All change orders must be approved by the Customer before the changed or additional work is performed.
Approval through Jobber, email, electronic signature, or another documented electronic method constitutes written approval.
The change order will identify the requested modification and, when applicable, any adjustment to the contract price and/or anticipated project schedule.
Verbal discussions, requests, or instructions do not constitute an approved change order.
5. UNFORESEEN SITE CONDITIONS
Pricing is based upon conditions reasonably observable when the project is estimated.
Construction may reveal concealed or unforeseen conditions, including buried concrete, debris, roots, unsuitable or unstable soil, excessive excavation requirements, abandoned irrigation, underground utilities, plumbing, electrical wiring, drainage systems, underground structures, or other conditions that could not reasonably have been identified beforehand.
Home Turf will notify the Customer if an unforeseen condition materially affects the contracted work. Additional work or charges resulting from such conditions require Customer approval through a written change order.
6. DEMOLITION, EXCAVATION & HAULING
Demolition, excavation, removal, hauling, and disposal are included only to the extent specifically identified in the Agreement.
Unexpected concrete, excessive base material, buried debris, roots, structures, hard soil, rock, or other materials requiring additional labor, equipment, hauling, or disposal may result in additional charges through an approved written change order.
7. GRADING & DRAINAGE
Home Turf will perform grading and drainage work specifically included in the Agreement using reasonable construction practices.
Unless drainage modification is specifically included, Home Turf is not responsible for correcting existing drainage conditions or redesigning drainage systems outside the contracted scope.
Home Turf does not warrant drainage conditions originating outside the contracted work area, including water originating from neighboring properties, roofs, pools, structures, municipal systems, or other areas outside Home Turf's control.
8. ARTIFICIAL TURF INSTALLATION
Artificial turf will be installed according to the specifications contained in the Agreement and Home Turf's installation practices.
Artificial turf is manufactured in rolls, and some installations require multiple pieces of material. Home Turf will use reasonable installation practices intended to minimize the appearance of seams.
Depending on the turf product, lighting, viewing angle, pile direction, project configuration, and normal use, seams may remain somewhat visible. Reasonable seam visibility does not by itself constitute defective workmanship.
Turf fibers may flatten or change direction through normal use and may require periodic brushing, grooming, or power brooming.
9. WEEDS & NATURAL VEGETATION
Artificial turf, pavers, rock, and other landscape improvements cannot permanently eliminate weeds or invasive vegetation.
Weed barriers, treatments, excavation, and installation practices may reduce future weed growth but cannot guarantee that weeds, Bermuda grass, nut grass, or other vegetation will never emerge.
Future weed growth is generally considered a maintenance condition and is not, by itself, evidence of defective workmanship.
10. REFLECTED SUNLIGHT & HEAT
Artificial turf and other landscape materials can be damaged by concentrated or reflected sunlight or heat.
Windows, glass doors, mirrors, metal surfaces, pool equipment, fire features, grills, and other surfaces or objects may concentrate heat sufficiently to melt, discolor, deform, or otherwise damage artificial turf or other materials.
Damage caused by reflected or concentrated sunlight, fire, excessive heat, or other external heat sources outside Home Turf's control is not considered a workmanship defect.
11. PAVERS, BLOCK, STONE & HARDSCAPE MATERIALS
Pavers, concrete products, block, stone, decorative rock, and other natural or manufactured materials may contain reasonable variations in color, shade, texture, dimensions, surface characteristics, and appearance.
Efflorescence can naturally occur in concrete and masonry products and does not necessarily indicate defective materials or workmanship.
Minor variations inherent in manufactured or natural materials are not considered workmanship defects.
12. MATERIAL & COLOR VARIATIONS
Home Turf cannot guarantee an exact match between different manufacturing lots, batches, dye lots, or previously installed products.
Artificial turf, pavers, block, stone, rock, and other materials installed or replaced at different times may have noticeable differences in color, texture, dimensions, appearance, or weathering.
Manufacturers may modify or discontinue products without notice.
13. IRRIGATION
Installation, repair, relocation, modification, or replacement of irrigation components is included only when specifically identified in the Agreement.
Existing irrigation systems may contain concealed, abandoned, deteriorated, damaged, improperly installed, or otherwise deficient components.
Home Turf is not responsible for existing irrigation deficiencies that were not caused by Home Turf.
Additional irrigation work discovered during construction that is outside the original scope requires an approved written change order before additional charges are incurred.
14. UNDERGROUND UTILITIES & PRIVATE LINES
The Customer is responsible for disclosing known privately installed underground improvements that may not be identified through normal utility location procedures.
These may include irrigation, landscape lighting wiring, pool or spa lines, private electrical wiring, plumbing, drainage systems, conduit, gas lines, or other buried improvements.
Home Turf will exercise reasonable care during excavation but is not responsible for damage to undisclosed or improperly located private underground improvements that could not reasonably have been identified before construction.
Nothing in this provision releases Home Turf from responsibility for damage resulting from Home Turf's negligence to the extent provided by applicable law.
15. CUSTOMER PROPERTY, PETS & CHILDREN
The Customer is responsible for removing or securing furniture, decorations, toys, hoses, equipment, vehicles, and other personal property from active construction areas.
Pets and children must be kept safely away from construction areas, materials, equipment, excavations, and work crews.
Home Turf is not responsible for damage resulting from the Customer's failure to reasonably secure personal property, children, or animals.
16. ACCESS TO PROPERTY
The Customer will provide Home Turf and its authorized employees, subcontractors, suppliers, vehicles, and equipment reasonable access to the project area during construction.
Unless otherwise agreed, the Customer will provide reasonable access to water and electrical service when necessary to perform the contracted work.
17. PERMITS, HOA REQUIREMENTS & APPROVALS
Responsibility for obtaining permits, engineering, inspections, HOA approvals, architectural approvals, or other authorizations will be as stated in the Agreement.
The Customer is responsible for informing Home Turf of known HOA restrictions, easements, deed restrictions, architectural requirements, or other private restrictions affecting the project.
If a governmental authority, HOA, engineer, inspector, or other applicable authority requires work beyond the original scope, additional work may require a written change order.
18. PROJECT SCHEDULING & DELAYS
Start and completion dates are estimates unless expressly guaranteed in writing.
Home Turf will make reasonable efforts to perform the project according to the anticipated schedule.
The project schedule may be affected by weather, extreme temperatures, material availability, manufacturer or supplier delays, permitting, inspections, HOA approvals, Customer requested changes, unforeseen site conditions, labor availability, emergencies, governmental action, or circumstances outside Home Turf's reasonable control.
Approved change orders may extend the anticipated completion date.
19. PROJECT COMPLETION & FINAL PAYMENT
The project is considered substantially complete when the contracted scope of work has been substantially performed and the improvement is capable of being used for its intended purpose, subject to legitimate minor final correction or corrective items.
Minor final correction or warranty items that do not materially prevent use of the completed project will be addressed by Home Turf within a reasonable period and do not, by themselves, postpone payment of amounts otherwise properly due.
The remaining contract balance and approved additional charges are due according to the payment terms contained in the Agreement.
20. ARTIFICIAL TURF PRODUCT WARRANTY
Artificial turf supplied and installed by Home Turf carries the product warranty applicable to the particular turf selected for the project, up to fifteen (15) years when provided by the applicable product warranty.
Product warranty coverage is governed by the terms, conditions, exclusions, limitations, and duration of the applicable written product or manufacturer's warranty.
If the applicable warranty is provided by the turf manufacturer, the manufacturer is responsible for determining coverage of manufacturing defects under its warranty.
If a selected turf product carries a warranty period other than 15 years, the actual written warranty applicable to that product will control.
21. HOME TURF LABOR & WORKMANSHIP WARRANTY
Home Turf provides a three (3) year labor and workmanship warranty on qualifying installation work performed by Home Turf.
The warranty period begins on the date the project is completed.
If the Customer reports a potential workmanship defect during the warranty period, Home Turf will be provided a reasonable opportunity to inspect the condition.
If a covered condition resulted from defective Home Turf workmanship, Home Turf will repair or correct the affected work in accordance with this warranty.
The workmanship warranty does not cover conditions caused by normal wear and tear, abuse, misuse, inadequate maintenance, pets, animals, weeds or invasive vegetation, reflected or concentrated heat, fire, flooding, extreme weather, soil movement, expansive soils, roots, pests, drainage conditions outside the contracted scope, alterations or repairs performed by others, vandalism, accidents, utility work, or damage caused by the Customer or other third parties.
22. WARRANTY CLAIMS
Warranty concerns should be reported to Home Turf in writing within a reasonable time after discovery.
The Customer will provide Home Turf reasonable access to inspect the claimed condition and a reasonable opportunity to perform covered corrective work.
Repairs, alterations, excavation, or modifications performed by others may affect warranty coverage to the extent those actions caused, contributed to, or prevented proper evaluation of the claimed condition.
23. WORK PERFORMED BY OTHERS
Home Turf does not warrant labor or materials provided by homeowners, other contractors, utility companies, pool companies, landscapers, or other third parties.
Damage to Home Turf's completed work caused by subsequent construction, excavation, alteration, repair, utility work, landscaping, pool work, or other outside activity is not considered defective Home Turf workmanship.
24. PHOTOGRAPHY & PROJECT DOCUMENTATION
Home Turf may photograph or record the project before, during, and after construction for project documentation, quality control, warranty records, training, portfolio, website, social media, and advertising purposes.
Home Turf will make reasonable efforts not to publicly display the Customer's name, street address, license plate, or other personally identifying information.
A Customer who does not want photographs or video of the completed project used for marketing purposes must notify Home Turf in writing before construction begins.
25. MATERIAL AVAILABILITY & SUBSTITUTIONS
Products may occasionally become unavailable, discontinued, backordered, or delayed for reasons outside Home Turf's control.
If a specified product becomes unavailable, Home Turf will discuss reasonable alternatives with the Customer.
Any material substitution that materially affects the price or appearance of the project requires Customer approval.
26. REBATES, INCENTIVES & OUTSIDE PROGRAMS
Home Turf does not guarantee Customer eligibility for any government, municipal, utility, water conservation, manufacturer, lender, or other outside rebate, incentive, credit, reimbursement, or program.
Unless expressly agreed otherwise in writing, the Customer's obligation to pay Home Turf is independent of whether an outside rebate, incentive, reimbursement, or benefit is ultimately approved or paid.
27. NONPAYMENT & COLLECTION
The Customer agrees to make payments according to the Agreement.
If an amount properly due remains unpaid, Home Turf reserves the right to exercise remedies available under the Agreement and applicable Arizona law, including lawful collection, suspension of work, and mechanic's lien remedies when applicable.
Nothing in these Terms & Conditions is intended to create, enlarge, waive, or restrict mechanic's lien rights except as permitted by Arizona law.
28. INDEMNIFICATION
To the extent permitted by Arizona law, the Customer agrees to indemnify and hold harmless Home Turf & Hardscapes LLC from outside claims, damages, losses, liabilities, and reasonable costs arising from the Customer's negligence, willful misconduct, breach of this Agreement, failure to disclose known hazardous or concealed conditions, or unauthorized acts or modifications performed by the Customer or persons acting at the Customer's direction.
This provision does not require the Customer to indemnify, hold harmless, or defend Home Turf & Hardscapes LLC for any loss or damage resulting from the negligence or other fault of Home Turf, its employees, subcontractors, consultants, or agents to the extent prohibited by Arizona law.
29. LIMITATION OF LIABILITY & CONSEQUENTIAL DAMAGES
To the fullest extent permitted by Arizona law, neither Home Turf nor the Customer will be liable to the other for special, incidental, indirect, exemplary, or consequential damages arising from the project, including lost profits, lost business opportunities, lost income, or similar indirect economic losses, except to the extent such damages cannot lawfully be limited or excluded.
This provision does not eliminate responsibility for direct damages resulting from negligence, breach of contract, defective workmanship, property damage, personal injury, or other liability that cannot legally be waived or limited.
30. DISPUTE RESOLUTION
If a dispute arises concerning the Agreement or project, Home Turf and the Customer agree to make a reasonable good faith effort to resolve the matter directly before pursuing additional remedies when practical.
Nothing in this provision prevents either party from exercising rights available under Arizona law or filing an appropriate complaint with the Arizona Registrar of Contractors.
31. ELECTRONIC COMMUNICATIONS, APPROVALS & SIGNATURES
The Customer agrees that electronic communications, signatures, approvals, estimates, invoices, change orders, and other project documents may be used in connection with the Agreement.
Electronic acceptance through Jobber or another mutually used electronic system will have the same effect as written acceptance to the extent permitted by applicable law.
32. ENTIRE AGREEMENT
The accepted Jobber estimate, quote, proposal, or contract, these Terms & Conditions, written scope of work, specifications, approved drawings or selections, applicable warranty documents, and approved written change orders collectively constitute the Agreement between Home Turf and the Customer.
If a project specific provision contained in the accepted Agreement directly conflicts with these general Terms & Conditions, the project specific provision will control for that project.
No verbal statement or representation modifies the Agreement unless documented in writing when required by these Terms & Conditions or applicable law.
33. SEVERABILITY & GOVERNING LAW
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
The Agreement is governed by the laws of the State of Arizona.
